Details of Will

I Thomas Byrd of Badsey, gentleman, give:

  • To my two daughters my horse and carriage for their own use
  • To my dear wife Sarah Byrd all that messuage or tenement situate at Badsey wherein I now dwell and the homestall garden and orchards thereto belonging and all those five cottages or tenements near to the said premises or some parts thereof now in the occupation of William Ballard, William Drinkwater, William Bingley, William Allard and Charles Knight and all those closes pieces or parcels of land lying together in Badsey field commonly called or known by the names of Pitchneys Closes, Bittern and Foxhill Field containing 145 acres and also the barn stable and buildings erected on the said last mentioned hereditaments to hold all to my said wife for and during the term of her natural life and from and immediately after her decease
  • As to the messuage or tenement now in my own possession and the homestall garden and orchards thereto belonging and also all those five cottages or tenements near to the same premises I give the same unto my two daughters Sarah and Mary for their natural lives and immediately after the decease of the survivor of them I give the same unto my son William Byrd his heirs and assigns for ever
  • And as to all the rest and residue of the aforesaid lands and other hereditaments hereinbefore given to my said wife for her life and which are now in the occupation of Mr Richard Gibbs from and immediately after the decease of my said wife I give and devise all to my son William Byrd his heirs and assigns for ever
  • To my son William Byrd all that my advowson donation free disposition and right of patronage and perpetual presentation of or to the vicarage of the church of Broadway and all messuages barns stables orchards gardens glebe lands tithes rents hereditaments oblations obstructions offerings augmentations pensions portions profits commodities rights members and appurtenances to the said vicarage belonging or therewith heretofore or now usually occupied or enjoyed or which are reputed to be a part parcel or member thereof to hold the said advowson of the said vicarage and hereditaments unto and to the use of my son William Byrd his heirs and assigns for ever
  • To my son Thomas Byrd all that my farm house and homestead situate in the hamlet of Aldington and all the buildings thereto belonging and all that farm or all those pieces or parcels of land or ground situate in the fields called Aldington Fields now occupied by my said son Thomas with the farm and homestead containing 130 acres and also all that messuage or farm house (now converted into three tenements) with the garden thereto adjoining situate in the village of Badsey now in the several occupations of Stephen Crisp, Joseph Knight and George Halford and also all those two pieces or parcels of pasture land or ground situate in Badsey called or known by the name of the Green Grounds together with the Three Ley Orchard now forming part of one of the said pieces of land or ground and all crops of grass corn or fruit which may be growing lying or being on the same which said pieces or parcels of land last mentioned adjoin the Turnpike Road leading from Badsey to the village of Bretforton and contain 17a 2r to hold unto Thomas my son for the term of his natural life and from and immediately after his decease I give and devise the same hereditaments and premises with the appurtenance unto and to the use of my grandson William Phillips Byrd his heirs and assigns
  • To my dear wife Sarah all my crops of corn grain pulse and hay whether growing or gathered at the time of my decease (except what I have before given to my son Thomas and all my farming stock both live and dead and implements of husbandry and all debts due and owing to me upon simple contract and all my ready money and money in the hands of my bank at Evesham to hold unto my wife for her own sole and absolute use subject nevertheless to the payment of my just debts and funeral expenses
  • As to the expenses of proving my will, I desire the same may be paid by my two daughters Sarah and Mary equally between them out of the residue of my personal estate
  • I give all my plate linen china and household furniture to my dear wife, my son William Byrd, and my daughters Sarah and Mary to be equally divided between them share and share alike or as near thereto as the nature of the same will permit and should there be any dispute in the division thereof which I do not expect will occur then I direct that the plate linen china and household furniture shall be sold and the produce of such sale shall be divided equally among them
  • I give all my stock in the public funds and all dividends from the Bank of England and all money upon Government or real leasehold or copyhold securities and all the rest and residue of my personal estate unto my two daughters Sarah and Mary for their own absolute use
  • I devise all mortgages and trust estates which may be now vested in me unto my two daughters Sarah and Mary subject to and upon the equities and trusts affecting the same
