I, Richard Davis, do swear that I will faithfully, impartially and honestly, according to the best of my skill and ability, execute and perform the several trusts, powers, and authorities vested and reposed in me as a Commissioner by virtue of an Act passed in the forty-seventh year of the reign of King George III intitled "An Act for inclosing Lands in the Hamlet of Aldington in the Parish of Badsey in the County of Worcester" according to equity and good conscience and without favour or affection, prejudice or partiality to any person or persons whomsoever. The Award of Richard Davis late of Lewknor in the County of Oxford but now of the Cross in the Parish of Aston Rowant in the said County and Thomas Fulljames of Hasfield Court in the County of Gloucester, a Gentleman, the Commissioners named and appointed in and by an Act of Parliament made and passed in the forty-seventh year of the reign of our Sovereign Lord George III by the grace of God of the United Kingdom of Great Britain and Ireland, King, Defender of the Faith, and in the year of our Lord 1807 intitled "An Act for inclosing Lands in the Hamlet of Aldington in the Parish of Badsey in the County of Worcester" and which is hereinafter called the Private Act. And the several persons whose names are hereunto subscribed and seals affixed being the exchanging parties to this Award, namely the Lord Bishop of Worcester, the Dean and Chapter of the Cathedral Church of Christ in Oxford of the foundation of King Henry VIII, George Day, Gentleman, the Perpetual Curate of the Parish Church of Badsey, the Reverend Thomas Williams, Thomas Byrd, Edward Laugher and William Chambers. Whereas the said Commissioners agreeable to the directions of the said Act have holden divers meetings for putting the said Act into execution and of the time and place of holding all such meetings except meetings by adjournment, they have caused Public notice to be given by writing affixed upon one of the principal doors of the Parish Church of Badsey in the County of Worcester at least 14 days before each meeting and of the time and place of holding the meeting for receiving claims and of the meeting for hearing objections to Roads, they have also caused such notices to be given as hereinafter mentioned, and of the time and place of holding the meeting for reading over and executing the Award they have caused ten days’ notice to be given in "The Worcester Journal".

And the said Commissioners at their first meeting before they proceeded in the execution of the powers contained in the said Act (except the power of giving notice of their first meeting) took and subscribed the oaths proscribed to be taken in and by an Act passed in the forty-first year of the reign of his present Majesty "for consolidating in one Act certain provisions usually inserted in acts of Inclosure and for facilitating the mode of proving the several facts usually required on the passing of such acts" and hereinafter called the general act, which oath was duly administered to and taken by them the said Commissioners and which said oath so taken and subscribed is hereto annexed in order that the same may be deposited with this their Award.

And whereas Henry Clark of Shipston upon Stone in the County of Worcester was appointed by the said Commissioners the Surveyor to be employed under the said Act who hath caused a survey, admeasurement and plan – all the Lands and Grounds to be divided, allotted and Inclosed by virtue of the said Act and of all the Messuages, Cottages, Orchards, Gardens, Homesteads, ancient Inclosed Lands and Grounds within the said Hamlet of Aldington aforesaid in the Parish of Badsey and County of Worcester aforesaid to be made and written and such survey admeasurement and plan hath been reduced into writing and the number of acres and decimal parts of an acre in statute measure contained in all the Lands and Grounds by the said Act directed or authorised to be divided, allotted and Inclosed and also in all the ancient Inclosed Lands, Grounds and Homesteads aforesaid and each and every proper and distinct property in the same hath been therein accordingly set forth and specified.

And the said Commissioners having made a valuation of all the said Lands, Grounds and Hereditaments and the survey, admeasurement and plan so as aforesaid written, having been duly verified on oath by the said surveyor hath been Open for the inspection of the said Commissioners and used for the purposes of the said Act.

And whereas the said Commissioners under the directions of the said general Act have holden a meeting to receive the claims of all persons claiming any Land Common right or interest whatsoever in or upon the Lands and Grounds within the said Hamlet of Aldington aforesaid in the Parish of Badsey aforesaid in the County of Worcester aforesaid or who were otherwise in any respect interested in the execution of the said Act which meeting they gave one notice not only in writing affixed upon one of the principal doors of the Parish Church of Badsey aforesaid but also by an advertisement inserted in "The Worcester Journal" previous to such meeting. And at such meeting claims were delivered to the said Commissioners on the part of the several Owners and Proprietors of the Homesteads, Gardens, Orchards, old Inclosures and other Lands and Grounds within the said Hamlet of Aldington aforesaid from which claims and from other information and evidence by them received, they the said Commissioners have fully informed themselves of the rights, properties and interests of the several persons interested in the said intended division and Inclosure.

And whereas the said Commissioners in obedience to the directions of the said general Act and before they proceeded to make any of the divisions and Allotments of the Lands within the said Hamlet of Aldington aforesaid intended to be divided and allotted in the first place set out and appointed such Public Carriage Roads and Highways as they judged necessary and also such Private Roads and Footpaths as appeared to them requisite and they caused a map to be prepared in which all such Roads have been accurately laid down by the said surveyor which map hath been deposited in the hands of Messrs Lavender and Byrch, Solicitors in Evesham, the Clerks to the said Commissioners for the inspection of all persons concerned and after such Roads were so set out and such map was so deposited as aforesaid they the said Commissioners caused notice thereof to be published in "The Worcester Journal" dated the twenty-ninth day of September 1807 and a copy of the same to be affixed upon the Church door of the Parish Church of Badsey aforesaid and thereby appointed a meeting to be holden at The Farriers Arms Inn in Evesham in the said County of Worcester on Wednesday the fourth day of November then next at the said Farriers Arms Inn, at which meeting all persons who might be injured or aggrieved by the setting out of such Roads were required to attend and at the meeting so holden agreeable to such notice, such Highways, Roads and Footpaths have been finally set out and confirmed with the entire approbation of the parties who attended such meeting as aforesaid in such manner and directions as the said Commissioners in their judgment considered upon the whole most convenient to all the parties interested.

And it was amongst other things in the said Private Act directed that in case there were any Homesteads, Gardens, Orchards, Home Closes or old Inclosed Lands and Grounds subject or liable to the payment of Tythes in kind or to any modus or composition or other payment in lieu of Tythes or any other ecclesiastical due as payment, the respective Proprietors whereof should not happen to be intitled to any or a sufficient specific Allotment to make compensation for the same, such Proprietors should respectively pay or cause to be paid unto such person or persons and at such time or times as the said Commissioners should direct or appoint such sum or sums of money as the said Commissioners doth adjudge and determine to be a full compensation and satisfaction for such Tythes, moduses, compositions or other payments in lieu of Tythes or other ecclesiastical due or payment issuing or payable out of such Homesteads, Gardens, Orchards, Home-closes and old Inclosed Lands and Grounds respectively or for such part thereof for which a compensation in Land could not be made by the Proprietors thereof as aforesaid which sum or sums of money should be applied towards payment of the charges and expenses of obtaining and passing the said Act and carrying the same and the said recited Act into execution. Now the said Commissioners pursuant to the powers and authorities vested in them as aforesaid have charged and assessed the following sums upon the several persons hereinafter named being those who were subject and liable to the provisions contained in such clause as aforesaid (viz) the sum of two hundred and three pounds nine shillings and seven pence upon John Jones, the sum of one hundred and seventy-three pounds and four pence upon Joseph Jones, the sum of eleven pounds twelve shillings and sixpence upon Edward Bootle, the sum of eleven shillings and eight pence upon John Phillips Esquire and the sum of one pound sixteen shillings and one penny upon William Savage. All which sums have been paid into the hands of the Treasurer appointed to receive such monies and have been applied towards payment of the charges and expenses as directed by the said Private Act which said several sums of money they do hereby adjudge and determine to be the full compensation and satisfaction for such Tythes, moduses, compositions or other payments in lieu of Tythes arising from their said several old Inclosed Lands and Grounds respectively or for such part thereof for which a compensation in Land could not be made by the Proprietors thereof as aforesaid.

And whereas the said Commissioners having completely finished the Allotments of the Messuages, Lands and Hereditaments by the said first mentioned Act authorised to be divided and allotted, have proceeded to form and draw up their Award agreeable to the directions of the said Act. And for the better observation of the several and respective matters contained in this their Award they the said Commissioners have thought it necessary and proper to cause a map and plan to be made on vellum of all the Homesteads, Gardens, Orchards, old Inclosed Lands and Grounds within the said Hamlet of Aldington aforesaid in the Parish of Badsey aforesaid which said map or plan is annexed to this their Award and intended to be deposited therewith and to be taken as a part thereof and the description of the several Allotments and of the several Roads, Ways and Footpaths hereinafter Awarded and set out are intended to refer to and to correspond with those in the said annexed map or plan contained.

Now therefore these presents witness and the said Commissioners in pursuance of the powers and authorities given to and vested in them in and by the said several hereinbefore mentioned acts and in obedience to the directions therein contained have set out and appointed and by these presents Do set out and appoint the following Roads and Footpaths over the Lands and Grounds by the said general Act directed to be allotted as aforesaid (that is to say):

Pitwell Road

One Public Carriage Road and Highway of the breadth of thirty feet branching out of the Turnpike Road leading from Bengworth to Littleton at or near Bowheadland Furlong and passing thence in an Eastward direction along its usual track through and over the said Common fields to the Village of Aldington and hereinafter called Pitwell Road.

Badsey Road

And one other Public Carriage Road and Highway of the like breadth of thirty feet branching out of an ancient Lane in the Village of Aldington aforesaid between the Homestead belonging to William Chambers, exchanged to the Curate of Aldington and an Orchard called the Great Orchard belonging to Thomas Byrd and passing thence in a Southward direction along its usual track to the Turnpike Road leading from Bengworth to Bretforton and thereinafter called the Badsey Road.

Private Road to the Parks

One Private Carriage Road and Driftway of the breadth of twenty-five feet branching out of the Turnpike Road leading from Bengworth to Littleton on the West side thereof and passing thence in a Westward direction into through and over the Allotment herein Awarded to John Millard, John Benton and Ann Slatter as Lessees under the said Dean and Chapter aforesaid to a gate at the entrance into an Estate called the Parks, which Road is set out, allotted and Awarded as and for a Private Carriage Road and Driftway for the time being for the use of the several Owners and Occupiers of the Allotments through and over which the same passes and for the Owners and Occupiers of the said Estate called the Parks.

Private Road to the Mill

Also one other Private Carriage Road and Driftway of the breadth of twenty feet branching out of the Turnpike Road leading from Bengworth to Littleton on the West side thereof at or near the North-East corner of the second Allotment herein Awarded to the said William Chambers and passing thence into through and over the same first in a West and then in a North direction to the South-East corner of the Allotment for the Tithe of Wool and Lamb and continuing from thence in a Northward direction through and over the said Allotment to a certain Horse and Foot Bridge leading to Fawk Mill in the Parish of Offenham which Road is set out, allotted and Awarded for the time being as and for a Private Carriage Road and Driftway for the use of the several Owners and Occupiers of the Allotments through and over which the same passes and for the Owners and Occupiers of the second Allotment herein Awarded to the said Curate as aforesaid. And also as and for a Private Carriage Road and Bridleway for the use of the Owners and Occupiers of the Mill called Fawk Mill.

Private Road to Jarretts Piece

And also one other Private Carriage Road and Driftway of the like breadth of twenty feet branching out of the Turnpike Road and leading from Bengworth to Bretforton on the South side thereof opposite the osier bed belonging to the said George Day and passing in a South direction to a gate at the entrance into an old Inclosure called Jarretts Piece belonging to John Jones which Road is set out and allotted and Awarded as and for a Private Carriage Road and Driftway for the time being for the use of the several Owners and Occupiers of the Allotment through and over which the same passes and for the use of the Owners and Occupiers of the said old Inclosures to which the same leads.

Footpath to Offenham

One Public Footpath of the breadth of four feet leading out of the Parish of Offenham at a foot-Bridge at Stanway Pleck and passing thence in or near its usual track in an Eastward direction through and over the third Allotment herein Awarded to the said George Day to a stile at the entrance of an old Inclosure called the Pasture Ground being part of the Public Footpath from Aldington to Offenham.

Also one other Public Footpath of the breadth of five feet leading out of the Parish of Bengworth at a stile near the South-West corner of Park Ditch Furlong and passing thence in or near its usual track through and over the first Allotment Awarded to the said William Chambers, the Allotment herein Awarded to the said John Millard, John Benton and Ann Slatter, Lessees as aforesaid, the second Allotment herein Awarded to the said William Chambers and the Allotment for the Tythe of Wool and Lamb to the said Horse and Foot Bridge leading to Fawk Mill being part of the Public Footpath from Bengworth to Offenham.

Also one other Public Footpath of the breadth of four feet leading out of the Village of Aldington at Pitwell Road on the South side thereof near Newland Butts and passing first in a West and then in a South direction in or near its usual track into through and over the first Allotment herein Awarded to the said Thomas Bird and the Allotment herein Awarded to the Marchioness of Downshire and Sir John Dashwood King, Lessees under the said Dean and Chapter, to the Turnpike Road leading from Bengworth to Bretforton, being part of the Public Footpath from Aldington to Bengworth.

And one other Public Footpath of the like breadth of four feet leading out of the Turnpike Road from Bengworth to Bretforton at a certain Bridge called Horse Bridge and passing thence in a South direction into, through and over the fifth ["fifth" is what appears in the text, but then in smaller, fainter ink above, "? first" has been written, "first" being correct] Allotment herein Awarded to the said John Jones to a stile at the entrance into a certain old Inclosures called Jarretts Ground belonging to the said John Jones being part of the Public Footpath from Bretforton to Bengworth.

And we the said Commissioners do hereby certify and declare that we have not diverted changed or altered any Turnpike Road leading into through and over the Hamlet of Aldington aforesaid but have left the Turnpike Road leading from Bengworth to Bretforton of its former breadth except a small part thereof adjoining to a certain Bridge called Horse Bridge which small Path lying West of the said Bridge we have set out and continued of the breadth of forty feet and the Turnpike Road leading from Bengworth to Littleton we have set out and continued also of the breadth of forty feet.

Herbage of Roads

And we the said Commissioners have Awarded ordered and directed and these presents do Award, order and direct that the grass and herbage arising from the said Turnpike Roads and the several Public Carriage Roads and Highways hereinbefore set out, allotted and Awarded shall for ever belong to and be the sole right of the Proprietors of the Lands and Grounds which next adjoin the said Roads and Ways on either side thereof as far as the crown of the Road. And the grass and herbage arising from the Private Roads and Footpaths hereinbefore set out shall for ever belong to and for the sole right of the several Proprietors through and over whose Allotments the same are set out, allotted and Awarded.

And the said Commissioners do hereby further certify and declare that all Roads, Ways and Paths over through and upon the Lands and Grounds by the said Private Act directed to be divided, allotted and Inclosed which have not been hereinbefore set out as aforesaid shall be for ever stopped up and extinguished and have by them been deemed and taken as part of the Lands and Grounds by the said last mentioned Act directed to be divided, allotted and Inclosed and which said Commissioners have divided and allotted accordingly.

Manorial Allotment, 1.0.20

And the said Commissioners in further pursuance of the directions of the said Private Act have set out and allotted and do by these presents Award unto and for George Day, Gentleman, as Lord of the Manor of Aldington aforesaid, All that piece or parcel of Meadow Land (being part of a certain Meadow called Upper Broadleys Meadow) containing one acre and twenty perches, bounded on the North by the Parish of Offenham, on the East and South by the first Allotment herein Awarded to the said George Day for the Farm and on the West by the Littleton Turnpike Road, which Allotment the said Commissioners do hereby declare is in their judgment a full compensation and satisfaction for the right of the said George Day as Lord of the Manor as aforesaid in or to the soil of the said Common and Waste Grounds. The Fences for enclosing the said Allotment are those on the East, the South and West sides thereof.

And the said Commissioners in further pursuance of the powers vested in them in and by the said Private Act and in obedience to the directions thereof have set out and allotted and by these presents do Award unto and for the Curate of the Perpetual Curacy of Badsey aforesaid and his Successors Curates as aforesaid, the said George Day for the Tithes claimed to be due and payable to him out of some portion of the Uninclosed Lands by the said last mentioned Act directed to be Inclosed and to the Dean and Chapter of the Cathedral Church of Christ in Oxford as Impropriators as aforesaid or their respective Lessees for and in lieu of their several and respective Tythes, such part or parcels of the said Lands and Grounds by the said last mentioned Act directed to be divided and Inclosed as should in the judgment of the said Commissioners be equal in value to one fifth part of all the Inclosed and Uninclosed Arable Lands within the said Hamlet of Aldington, one seventh part of all the convertible Inclosures in the said Hamlet or such as have been broken up and sometimes Arable and sometimes Greensward within twenty years last past and one ninth part of all the Homesteads, Orchards and old Inclosed Meadow and Pasture Lands and Waste Grounds respectively subject and liable to the payment of Tythes in kind and which remain after the Public and Private Drains and Roads and Allotments for the said Stone Gravel and Land Pits and for the Lord of the Manor have been taken out and deducted.

And the said Commissioners have deducted the said Allotments for the said Tythes respectively from and out of the respective shares of the Commonable Lands by the said last mentioned Act directed to be divided and Inclosed which belong to the several persons whose Uninclosed or Inclosed Lands have paid to the time of passing the said Private Act and now pay Tythes as aforesaid in proportion and according to the value or amount of such Tythes due from and payable by them respectively.

And the said Commissioners have set out and divided and apportioned and by these presents do Award the said Allotments so directed to be made for and in lieu of the said respective Tythes as before mentioned to and between the said Dean and Chapter as Impropriators as aforesaid and their Successors and their respective Lessees and the said Curate and his Successors in severalty in such shares and proportions as we the said Commissioners so adjudge and determine to be an equal and just compensation and satisfaction for the respective shares rights and interests of the said Impropriators, Lessees and Curate respectively of and in the said respective Tythes according to the respective proportions rights and interests therein in manner and form following (that is to say).

Curate of Badsey, 1st Allotment, 13.0.20

To and for the said Curate of the Perpetual Curacy of Badsey aforesaid and his Successors Curates as aforesaid, All those several pieces or parcels of Land, Messuages, Barn, Stables and Buildings next hereinafter mentioned and described (that is to say), All that piece or parcel of Land situate in the Halfpenny Piece, Newland Furlong, the furlong shooting against the Turnpike Road leading from Bengworth to Bretforton and places adjacent, containing thirteen acres and twenty perches, bounded on the North by the first Allotment herein Awarded to Edward Laugher, on the East by Badsey Road, on the South by the Bretforton Turnpike Road and on the West by the Allotment herein Awarded to the Marchioness of Downshire and Sir John Dashwood King as Lessees as aforesaid. The Fences for inclosing the said Allotment are those on the North, the East and South sides thereof.

Curate of Badsey, 2nd Allotment, 7.0.23

Also all that other piece or parcel of Land situate in Fawk Brook Furlong, Fawk Mill Meadow and places adjacent containing seven acres and twenty-three perches, bounded on the North by the Parish of Offenham, on the East and on part of the South by the Allotment herein Awarded to Philip Rock, on the remaining part of the South and on part of the West by the second Allotment herein Awarded to the said William Chambers and on the remaining part of the West by the Allotment for the Tythe of Wool and Lamb. The Fences for inclosing the said Allotment are those on all parts except against the Parish of Offenham.

Curate of Badsey, 3rd Allotment, 0.1.25

And also all that Messuage (now divided into Two Dwelling Houses), Barns, Stables and other Buildings, together with the site thereof situate in the Village of Aldington aforesaid with the Garden, Foldyard and Rickyard thereto adjoining and belonging now or late in the occupation of the said William Chambers or his tenants, containing together one rood and twenty-five perches, bounded on the North by a Garden and Buildings belonging to the said Edward Laugher, on the East, the South-East and South by a Lane leading into the Village of Aldington aforesaid and on the West by the first Allotment herein Awarded to the said Edward Laugher, which said Messuage, Barn, Stables and other Buildings, together with the site thereof, Garden, Foldyard and Rickyard aforesaid are so set out and allotted and Awarded by and with the consent and approbation of the said William Chambers and the said Curate as aforesaid, the said Dean and Chapter as patron of the said Perpetual Curacy of the Parish Church of Badsey and the Right Reverend the Lord Bishop of the said Diocese, testified by their severally signing and affixing their respective seals to these presents.

Allotment for Wool and Lamb, 8.2.0

And whereas the small or vicarial Tythes arising within the whole of the Hamlet of Aldington aforesaid have been claimed by the said Curate as aforesaid and the Tythe of Wool and Lamb are also claimed by the said John Millard, John Benton and Ann Slatter as Lessees under the said Dean and Chapter and it not appearing to the said Commissioners which or whom of the said respective claimants are in the actual possession of the rents and profits of the said Tythe of Wool and Lamb.

They have therefore set out and allotted and by these presents do Award unto and for the person or persons who is, are or may be lawfully intitled to the said Tythe of Wool and Lamb, All that piece or parcel of Land situate in Aldington Leys and Aldington Common containing eight acres and two roods, bounded on the North by the Parish of Offenham aforesaid, on the East by the second Allotment herein Awarded to the said Curate as aforesaid, on the South by the second Allotment herein Awarded to the said William Chambers, and on the West by the Parks aforesaid. The Fences for inclosing the said Allotment are those on the South side thereof.

Allotment for Tithe of Hay, 9.2.14

To the most honourable the Marchioness of Downshire and Baroness Sandys and Sir John Dashwood King, Baronet, or one of them who is or are intitled under a lease from the Dean and Chapter of the Cathedral Church of Christ in Oxford of the foundation of King Henry VIII for the remainder of a term of twenty-one years to the Tythe of Hay arising and becoming due within the said Hamlet of Aldington, All that piece or parcel of Land situate in the furlong shooting against the Bretforton Turnpike Road, Newland Butts and places adjacent, containing nine acres two roods and fourteen perches, bounded on part of the West and on part of the North by the first Allotment herein Awarded to the said Thomas Bird, on the remaining part of the North by the first Allotment herein Awarded to the said Edward Laugher, on the East by the first Allotment Awarded to the said Curate as aforesaid, on part of the South by the Bretforton Turnpike Road, and on the remaining parts of the West and South by Bengworth new Inclosures. The Fences for inclosing the said Allotment are those on the North and East sides and on the South against the said Turnpike Road.

Allotment to John Millard and Others, 55.1.24

To and for John Millard, John Benton and Ann Slatter, widow, who are intitled as Lessees under the said Dean and Chapter to all other their Great Tythes arising and continuing within the said Hamlet of Aldington for the remainder of a term of twenty-one years, All that piece or parcel of Land situate in the Furze Furlong, Broad Furze Leys, Aldington Common and places adjacent, containing fifty-five acres one rood and twenty-four perches, bounded on the South by the first and on the North by the second Allotment herein Awarded to the said William Chambers, on the East by the Littleton Turnpike Road, and on the West by the Parks aforesaid. The Fences for inclosing the said Allotment are those on the East against the said Turnpike Road.

Tithe Allotment to George Day, 2.2.20

To and for George Day, Gentleman, who is or claims to be intitled to a certain small portion of Tythes issuing out of certain Lands in the Hamlet of Aldington in a field or furlong called Newland Fields, All that piece or parcel of Land situate in Wet Furrows Furlong and Deadland Furlong containing two acres two roods and twenty perches, bounded on the North and East by the first Allotment herein Awarded to the said George Day for the Farm, on the South by the second Allotment herein Awarded to the said Thomas Bird and on the West by the Littleton Turnpike Road. The Fences for inclosing the said Allotment are those on the South and West sides thereof.

And the said Commissioners do hereby declare adjudge and determine that the several Allotments, Lands, Buildings and Premises hereinbefore set out, allotted and Awarded to the said Curate as aforesaid, the person or persons who shall be lawfully intitled to the said Tythe of Wool and Lamb, the said Marchioness of Downshire and Sir John Dashwood King or one of them as Lessee or Lessees as aforesaid, the said John Millard, John Benton and Ann Slatter as Lessees as aforesaid, and the said George Day respectively, to be an equal and just compensation and satisfaction for the respective shares, rights and interests of the said Impropriators, Lessees and Curate respectively of and in the said respective Tythes according to their respective proportions, rights and interests therein.

And the said Commissioners in further pursuance of the powers vested in them by the said Private Act have assigned, set out and allotted and by these presents do Award all the residue and remainder of the said Open and Common fields, Meadows, Pastures, Commonable Lands and Waste Grounds by the said Private Act directed to be divided and Inclosed unto the several other persons intitled to or having right of Common or other interest therein in such shares, quantities and proportions and in such manner as the said Commissioners adjudge and determine to be a fair, just and reasonable compensation and satisfaction and equal in value to their several and respective shares, properties, right of Common and other rights and interests of in to and over the same Lands and Grounds, quantity, quality and situation of such Uninclosed Lands and the Allotments made in lieu thereof always considered and in the judgment of the said Commissioners have formed thereof and by this their Award determine in manner and form following (that is to say):

George Day for the Farm, 1st Allotment, 72.1.16

To and for George Day, Gentleman, All those seven several pieces or parcels of Lands, Buildings and Premises next hereinafter mentioned and described (that is to say), All that piece or parcel of Land situate in Lower Hundred Lands, Long Headland Furlong, Town Meadow and places adjacent, containing seventy-two acres one rood and sixteen perches, bounded on part of the North and on part of the West by the Manorial Allotment herein Awarded to the said George Day, on the remaining part of the North and on the North-East by the Parish of Offenham, on the East by old Inclosures called the Pastures belonging to the said George Day, on part of the South by Homesteads and Orchards belonging to the said George Day and Philip Rock respectively, on other part of the West and on other part of the South by the Allotment herein Awarded to the said George Day for the Estate late Brooks’s, on other parts of the West and on other parts of the South by the second Allotment herein Awarded to the said Thomas Bird, on other part of the West and on the remaining part of the South by the Tithe Allotment herein Awarded to the said George Day and on the remaining part of the West by the Littleton Turnpike Road. The Fences for inclosing the said Allotment are those on the West against the Allotment herein Awarded to the said George Day for late Brooks, on all parts and sides against the second Allotment herein Awarded to the said Thomas Bird, on the West and South against the said Tithe Allotment herein Awarded to the said George Day, and on the West against the said Turnpike Road.

George Day for the Farm, 2nd Allotment, 0.2.12

Also all that other piece or parcel of old Inclosed Land called the Park, containing two roods and twelve perches, bounded on the North by a Lane or Street in the Village of Aldington aforesaid, on the East by a Cottage and Garden belonging to the said John Phillips and an Orchard belonging to the said Edward Bootle, on the South by an Orchard belonging to the said Edward Laugher, and on the West by the second Allotment herein Awarded to the said Edward Laugher and an old Inclosure belonging to the said Philip Rock, which said Inclosure called the Park is set out, allotted and Awarded as aforesaid by and with the consent of the said William Chambers testified by his signing and sealing these presents.

George Day for the Farm, 3rd Allotment, 2.0.7

Also all that Messuage, Barn, Stable and Buildings situate in the Village of Aldington aforesaid, together with the sites thereof, Foldyard, Garden and Orchard thereto adjoining and belonging, containing two acres and seven perches, bounded on the North by the first Allotment herein Awarded to the said George Day for the Farm, on the East by an Orchard and Homestead called late Brooks’s belonging to the said George Day, on the South by a Lane or Street in the Village of Aldington, and on the West by the Homestead and Orchard belonging to the said Philip Rock.

George Day for the Farm, 4th Allotment, 0.1.30

Also all that other piece or parcel of old Inclosed Land called the Little Orchard situate in the Village of Aldington aforesaid containing one rood and thirty perches, bounded on the North and East sides by Lanes or Streets in the Village of Aldington aforesaid, on the South and part of the West by a Garden and Orchard belonging to the said Edward Bootle, and on the remaining part of the West by Cottages and Gardens belonging to the said Edward Laugher and exchanged to the said George Day, which said Messuage, Barn, Stable and Buildings together with the sites thereof, Foldyard, Garden and Orchard thereto adjoining and belonging and the Orchard called the Little Orchard are set out, allotted and Awarded as aforesaid by and with the consent and approbation of the said Thomas Williams, testified by his signing and sealing these presents as well as by an Agreement between him and the said George Day bearing date on or about the twenty-seventh day of June in the year of our Lord 1806.

George Day for the Farm, 5th Allotment, 0.0.16

Also all that Messuage divided into four dwellings with the site thereof and Gardens thereto adjoining situate in the Village of Aldington aforesaid, heretofore the property of the said Edward Laugher, containing sixteen perches, bounded on the North by a Street or Lane in the Village of Aldington aforesaid, on the East by a Close called the Little Orchard hereinbefore Awarded to the said George Day, on the South by an Orchard belonging to the said Edward Bootle, and on the West by a Messuage and Garden belonging to the said John Phillips.

George Day for the Farm, 6th Allotment

Also all that Blacksmith’s Shop and part House situate in or near the Village of Aldington aforesaid together with the site thereof, bounded on the West and North by the Allotment Awarded to the said George Day for late Brookes’s, on the East by a Cottage Garden belonging to the said George Day, and on the South by Pitwell Road aforesaid, the said Messuage, Garden, Blacksmith’s Shop and part House being Awarded as aforesaid by the said Commissioners by and with the consent of the said Edward Laugher testified by his signing and sealing these presents (which last six Allotments of Land together with the Messuages, Barns, Buildings, Blacksmith’s Shop and part House), Hereditaments and Premises last hereinbefore set out, allotted and Awarded to the said George Day, the said Commissioners do hereby declare, adjudge and determine to be a fair, just and reasonable compensation to the said George Day for his Common field Estate called the Farm and the several parcels of old Inclosed Lands called Black Bank Meadow, Black Bank Ground, Far Parks otherwise flax Ground, Hither Parks otherwise flax Ground and the Mill Dam together with the timber and trees growing therein and hereinafter Awarded to the said Thomas Williams also together with the sum of one hundred and thirty-one pounds three shillings to be paid by the said Thomas Williams to the said George Day.

Allotment to George Day for late Brookes’s, 19.0.24

And also unto and for the said George Day, All that piece or parcel of Land situate in the Bitton Piece, the Waste Land adjoining thereto the Upper Hundred Lands and places adjacent, containing nineteen acres and twenty-four perches, bounded on the North and part of the East by the first Allotment herein Awarded to the said George Day for the Farm, on the remaining part of the East by a Homestall and Orchard belonging to Philip Rock, on part of the South by a Cottage and Garden belonging to the said George Day, on the remaining part of the South and on the South-West by Pitwell Road aforesaid, and on the West by the second Allotment herein Awarded to the said Thomas Bird, and which Allotment the said Commissioners do hereby declare, adjudge and determine to be a fair, just and reasonable compensation to the said George Day for his Estate late Brooks’s and right of Common thereto belonging in and over the said Lands by the said Act directed to be divided and Inclosed. The Fences for inclosing the said Allotment are those on the South and South-West against Pitwell Road, on the West against the second Allotment herein Awarded to the said Thomas Bird, and on the North against the first Allotment herein Awarded to the said George Day for the Farm.

The Reverend Thomas Williams

To and for the Reverend Thomas Williams, All those several pieces or parcels of old Inclosed Land next hereinafter described (that is to say), Black Bank Meadow containing five acres one rood and sixteen perches, Black Bank Ground containing six acres and four perches, Far Parks otherwise Flax Ground containing thirteen acres two roods and four perches, Hither Parks otherwise Flax Ground, containing thirteen acres three roods and twenty perches, which said four Closes adjoin to each other and contain thirty-eight acres three roods and four perches, bounded on the North by the Parish of Offenham, on the East by old Inclosures of Badsey, on the South by the Bretforton Turnpike Road, and on the West by the Closes called the Hanging Grounds belonging to the said George Day. And all that other old Inclosed Meadow called the Mill Dam containing two acres three roods and twenty-six perches, bounded on the North, the East and the South by Lands in the Parish of Offenham belonging to the said Thomas Williams and on the West by the Brook dividing the Closes called the Cow Pasture belonging to the said George Day from the said Mill Dam Meadow, which said several Inclosures so set out, allotted and Awarded as aforesaid (by and with the consent and approbation of the said George Day) testified by his signing and sealing these presents as well as by the agreement hereinbefore described together with the sum of one hundred and thirty-one pounds three shillings hereinbefore mentioned and agreed to be paid by the said Thomas Williams to the said George Day. The said Commissioners do hereby declare, adjudge and determine to be a fair, just and reasonable compensation to the said Thomas Williams for his Open field, Land, rights of Common, Messuages, Barns, Buildings and old Inclosed Lands hereinbefore assigned and Awarded to the said George Day.

Thomas Bird, First Allotment, 80.2.15

To and for Thomas Bird, Gentleman, all those three several pieces or parcels of Land and hereinafter mentioned and described (that is to say), All that piece or parcel of Land situate in Newland Piece, Newland Butts, the Seven Lands, Styers Knap Furlong and places adjacent containing eighty acres two roods and fifteen perches, bounded on the North-East by Pitwell Road, on part of the East by the second Allotment, and on part of the South and on part of the East by the first Allotment herein Awarded to the said Edward Laugher, on other part of the South and on the remaining part of the East by the Allotment herein Awarded to the said Marchioness of Downshire and Sir John Dashwood King, Lessees as aforesaid, on other parts of the South and on parts of the West by Bengworth new Inclosures, and the remaining part of the West by the Littleton Turnpike Road. The Fences for inclosing the said Allotment are those on the North-East against Pitwell Road, those on the East at Newland Butts against the Allotment herein Awarded to the said Marchioness of Downshire and Sir John Dashwood King, Lessees as aforesaid, and those on the West against the last mentioned Turnpike Road.

Thomas Bird, Second Allotment, 46.3.4

Also that other piece or parcel of Land situate in Long Newland Furlong, Pitwell Furlong, Deadland Furlong, Wet Furrows and places adjacent, containing forty-six acres three roods and four perches bounded on the South-West by Pitwell Road, on the West by the Littleton Turnpike Road, and on all other parts and sides thereof by Allotments herein Awarded to the said George Day. The Fences for inclosing the said Allotment are those against Pitwell Road and Littleton Turnpike Road.

Thomas Bird, Third Allotment, 0.0.19

And also all that other piece or parcel of Land situate upon the Waste Land opposite the Halfpenny Piece containing nineteen perches, bounded on the North by the Great Orchard belonging to the said Thomas Bird, on the East by the Brook, and on the South-West by the Badsey Road aforesaid. The Fences for inclosing the said Allotment are those against the said Road, which said three Allotments lastly hereinbefore Awarded to the said Thomas Bird the said Commissioners do hereby declare adjudge and determine to be a fair, just and reasonable compensation and satisfaction to the said Thomas Bird for the Estate and right of Common thereto in, over and upon the Lands by the said Act directed to be divided and Inclosed and also a fair just and reasonable compensation and satisfaction for that part of the Great Orchard belonging to the said Thomas Bird taken therefrom for the purpose of widening the Lane in the Village of Aldington aforesaid and for making the new Fence against the said Road and which is so taken by and with the consent and approbation of the said Thomas Bird by his signing and sealing these presents.

William Chambers, First Allotment, 6.3.23

To and for William Chambers, All those two pieces or parcels of Land next hereinafter mentioned and described (that is to say), All that piece or parcel of Land situate in Park Ditch Furlong and places adjacent, containing six acres three roods and twenty-three perches, bounded on parts of the North and North-East by the Allotment herein Awarded to John Millard, John Benton and Ann Slatter, Lessees as aforesaid, on part of the East by the Littleton Turnpike Road, on the remaining part of the East and on the South by Bengworth new Inclosures, and on the West by the Parks aforesaid. The Fences for inclosing the said Allotment are those against the Allotment Awarded to the said John Millard, John Benton and Ann Slatter as Lessees as aforesaid and against the said Turnpike Road.

William Chambers, Second Allotment, 19.0.24

And all that piece or parcel of Land situate in the furlong below Furze Furlong, Aldington Common and places adjacent, containing nineteen acres and twenty-four perches, bounded on part of the North by the Allotment herein Awarded for the Tithe of Wool and Lamb, on part of the East and other parts of the North by the second Allotment herein Awarded to the said Curate as aforesaid, on the remaining part of the North by the Allotment herein Awarded to Philip Rock, on the remaining part of the East by the Littleton Turnpike Road, on the South by the Allotment herein Awarded to the said John Millard, John Benton and Ann Slatter, Lessees as aforesaid, and on the West by the Farm called the Parks.

The Fences for inclosing the said Allotments are those on the East against the said Turnpike Road and on the South against the Allotment herein Awarded to the said John Millard, John Benton and Ann Slatter as Lessees as aforesaid. Which said two Allotments lastly hereinbefore set out, allotted and Awarded to and for the said William Chambers, the said Commissioners do hereby declare, adjudge and determine to be a fair, just and reasonable compensation and satisfaction to the said William Chambers for his Estate and right of Common thereto belonging in, over and upon the Lands by the said Act directed to be divided and Inclosed and also a fair, just and reasonable compensation for the Messuage, Barn, Stable and other Buildings situate in the Village of Aldington aforesaid, together with the site thereof, with the Garden, Foldyard and Rickyard thereto adjoining hereinbefore Awarded to the said Curate as aforesaid. Also for the old Inclosure called the Park hereinbefore Awarded to the said George Day and for the Garden hereinafter Awarded to the said Edward Laugher, which said Messuage, Barn, Stable and other Buildings, together with the site thereof, with the Garden Foldyard and Rickyard thereto adjoining the said old Inclosure called the Park and the said Garden have been so set out, allotted and Awarded as aforesaid by and with the consent and approbation of the said William Chambers, the said Dean and Chapter as patrons as aforesaid, the said Curate, the said George Day and Edward Laugher respectively testified by their severally signing and affixing their respective seals and sealing these presents.

Allotment to Philip Rock, 12.0.8

To and for Philip Rock, All that piece or parcel of Land situate in the Lower Broadleys Meadow, Fawk Mill Furlong and places adjacent, containing twelve acres and eight perches, bounded on part of the North by the Parish of Offenham, on the East by the Littleton Turnpike Road, on the South by the second Allotment herein Awarded to the said William Chambers and on parts of the West and on the remaining part of the North by the second Allotment herein Awarded to the said Curate as aforesaid, which said Allotment the said Commissioners do hereby declare, adjudge and determine to be a fair, just and reasonable compensation and satisfaction to the said Philip Rock for his Estate and right of Common thereto belonging in, over and upon the Lands by the said Act directed to be divided and Inclosed. The Fences for inclosing the said Allotment are those on the East and South sides thereof.

Edward Laugher, 1st Allotment, 6.1.30

To and for Edward Laugher, All those three pieces and parcels of Land next hereinafter mentioned and described (that is to say), All that piece or parcel of Land situate in Newland Butts, Newland Pieces and places adjacent, containing six acres one rood and thirty perches, bounded on part of the West and on part of the North by the first Allotment herein Awarded to the said Thomas Bird, on the North-East, on other part of the North by the second Allotment and an Orchard belonging to the said Edward Laugher, on part of the East and other part of the North by a Garden herein Awarded to the said Edward Laugher, on other part of the East by the Homestead herein Awarded to the said Curate, on the remaining part of the East by an ancient Lane in or near the Village of Aldington aforesaid, and on the South by Allotments herein Awarded to the said Curate as aforesaid and the said Marchioness of Downshire and Sir John Dashwood King respectively as Lessees as aforesaid. The Fences for inclosing the said Allotment are those on the North and West against the first Allotment herein Awarded to the said Thomas Bird.

Edward Laugher, 2nd Allotment, 2.0.33

Also all that other piece or parcel of Land situate in Newland Butts containing two acres and thirty-three perches and bounded on part of the North by Pitwell Road aforesaid, on part of the East and on the remaining part of the North by an old Inclosure belonging to Philip Rock, on the remaining part of the East by an old Inclosure called the Park hereinbefore Awarded to the said George Day, on the South by an Orchard belonging to the said Edward Laugher, and on the West by the first Allotment herein Awarded to the said Edward Laugher and the first Allotment Awarded to the said Thomas Bird. The Fences for inclosing the said Allotment are those on the North against Pitwell Road and on the West against the first Allotment Awarded to Thomas Bird.

Edward Laugher, 3rd Allotment, 0.0.20

And also all that other piece or parcel of Land being a Garden late the property of the said William Chambers situate in or near the Village of Aldington aforesaid containing twenty perches, bounded on the North and East by an Orchard and Garden belonging to the said Edward Laugher and on the South and West by the first Allotment herein Awarded to the said Edward Laugher, which Garden is Awarded as aforesaid by and with the consent of the said William Chambers and Edward Laugher and respectively testified by their severally and respectively signing and sealing these presents, which said Allotments the said Commissioners do hereby declare, adjudge and determine to be a fair, just and reasonable compensation and satisfaction to the said Edward Laugher for his Estate and right of Common thereto belonging in over and upon the Lands by the said Act directed to be divided and Inclosed and also a fair, just and reasonable compensation for the Cottages with the site thereof and Gardens, Blacksmith’s Shop and part House hereinbefore Awarded to the said George Day.

Allotment to John Jones, 0.0.12

To and for John Jones, All that piece or parcel of Land situate upon the Waste Land near the Horse Bridge containing twelve perches, bounded on the North by the Bretforton Turnpike Road, on the East by the Brook, and on the South by Jarrett’s Ground belonging to the said John Jones, which Allotment lastly hereinbefore set out, allotted and Awarded, the said Commissioners do hereby declare, adjudge and determine to be a fair, just and reasonable compensation and satisfaction to the said John Jones for the right and interest in and upon the Lands by the said Private act, directed to be divided and Inclosed. The Fence for inclosing the said Allotment is that on the North side thereof.

And the said Commissioners do hereby certify and declare that the Allotments contain the quantities before mentioned exclusive of a Private Road and footways leading over the same And the said Commissioners do hereby further Award, order and direct that the Fences for inclosing the several Allotments hereinbefore Awarded shall be made within six months from the date hereof and for ever after be maintained and kept in repair by and at the expense of the respective Owners of the Allotments to which such Fences belong (save and except those of the Tithe Allotments) with quicksets and ditches of four feet in width from the lower table and of sufficient depth to convey the water and with proper gates and stiles across the Private Roads and Footpaths.

And the said Commissioners have contracted with the said George Day for the making the ring Fences hereinbefore directed for inclosing the Allotments herein Awarded to the said Curate as aforesaid, to the Owner or Owners of the Allotment herein Awarded for the Tythe of Wool and Lamb the Marchioness of Downshire and Sir John Dashwood King as Lessees as aforesaid, and also having as well contracted with the said William Chambers for making the ring Fences hereinbefore directed for inclosing the Allotment herein Awarded to John Millard, John Benton and Ann Slatter, Lessees as aforesaid, with quicksets and posts and rails on both sides thereof and ditches of four feet from the lower table and of sufficient depth for conveying the water, the expense of which, pursuant to the directions of the said Act are to be borne and defrayed by the several persons to whom any other Allotments or an Allotment should be made by virtue of the said Act in such proportions as the said Commissioners shall appoint, which Fences are for the space of seven years from the date of the said Commissioners’ Award, to be maintained, preserved and kept in repair by and at the expense of the said George Day and William Chambers according to their respective contracts before mentioned.

And the said Commissioners do hereby Award, order and direct that from and after the expiration of the said term of seven years, such Fences shall be supported and be for ever maintained and kept in repair by and at the expense of the several and respective persons to whom the same belong.

And the said Commissioners do hereby Award, order and direct that all Private Roads hereinbefore set out shall be maintained and kept in repair in the same manner as the Public Highways are by law directed to be amended and kept in repair.

And the said Commissioners do hereby further declare that they have not turned or diverted any Watercourse in the said Hamlet and do order and direct that all Watercourses shall be scoured and cleansed in a good and sufficient manner by the several Owners and Proprietors of the Lands adjoining to the same respectively or in such places where Watercourses adjoin old Inclosures, the Proprietors of the said old Inclosures whose right it formerly was to scour and cleanse the same. In witness whereof the parties to these presents have hereunto set their hands and seals the fourth day of October in the year of our Lord 1808.
