Damages to Cabbages at Wickhamford

William Bennett, gardener, Badsey, v Joseph Pope, farmer, Clerkenleap, Worcester.  Claim £7 10s, damages done to a crop of cabbages by the sheep on defendant’s farm at Wickhamford.  Mr Harry J Smith was for plaintiff, and Mr Geoffrey New for defendant.  Witnesses for the defendant put the damage at £3.  His Honour pointed out that the evidence as to the extent of the land was contradictory, and they had no professional gentleman to speak as to that.  They had plaintiff’s word, and he saw no reason to doubt it.  They might judge by the number of plants, but then the plants might be planted thickly.  The jury found for plaintiff for £5.
