I Edward Appelbee of Badsey, Gentleman, being appointed one of the executors in the will of John Jones late of Badsey Gentleman deceased have for certain causes me hereunto relinquished my title in the executrion of the will (and do sesire that the will may be proved by Mary Wheeler the executrix named) and I do further appoint Mr Gervase Clifton, one of the Procurators General of the Episcopal Consistory Court of Worcester granting unto him full power and authority for me and in my name to appear before the Worshipful Joseph PhillimoreDoctor of Laws, Chancellor of the Dicoes of Worcester his lawful surrogate or other competent judge in this behalf and before him to exhibit this my free and voluntary proxy of renunciation and to act and do all and every thing lawful and necessary to be done
 

I John Jones of Badsey, Gentleman

  • Direct that my funeral and testamentary expenses and all and singular my debts whether on mortgage bond or otherwise as also the principal sum of £650 charged on my real estate by the will of my late father and all interest in respect thereof together with the legacies hereinafter by me given shall be paid and discharged by my executors hereinafter named and out of the monies to be saved by sale or mortgage of such part of my real estate as is hereinafter given and devised unto and to the use of or in trust for my brother Joseph Jones and his children and I exonerate my personal estate of and from all and every such payments:
  • To my niece Mary Wheeler the sum of £450
  • To my two great-nephews Christopher Wheeler and James Wheeler the sum of £50 each
  • To Mary Wheeler all my household furniture and implements of household, ready monies, plates and all and singular other my personal estate and effects for her own sole and absolute use and disposal
  • To the use of Mary Wheeler her heirs and assigns (free from all incumbrances whatsoever) all that messuage or dwelling-house in which I am now residing together with the homestead yards gardens and orchard thereto adjoining with the appurtenances in the village of Badsey and now in the possession of myself and my tenant Mr Thomas Sheaf which said hereditaments and premises above devised are bounded in the front by the street in Badsey at the back thereof by Badsey Brook on one side, by hereditaments belonging to the said Joseph Jones and on the other side by hereditaments belonging to the Reverend William Byrd and others in the occupation of the said Thomas Sheaf or fromsoever otherwise the same premises are bounded know or distinguished.
  • And I give and devise all those my several closes, pieces or parcels of land with the appurtenances belonging situate in the parish of Badsey and now in the occupation of Thomas Sheaf as tenant and all and singular other my real estate not hereinbefore disposed of to the uses following, that is to say to the use of the said Mary Wheeler and my friend Edward Appelbee of Badsey, Gentleman, upon trust that Mary Wheeler and Edward Appelbee or the survivor of them or the executors do and shall by mortgage sale demise or other disposition of the said hereditaments and premises or a competent part thereof for the whole or any part of the said term of 2000 years …
  • To Mary Wheeler and Edward Appelbee all estates which at the time of my decease shall be vested in me upon trust or by way of mortgage
